Terms of service

1. Who provides this service

Findingbase is operated by [OPERATOR: fill] legal entity name, form and registration number, whose registered office is at [OPERATOR: fill] registered office address.

Mail can be sent to: [OPERATOR: fill] set POSTAL_ADDRESS in the environment; the mailing address is also required on every commercial email.

“We” and “us” mean that entity. “You” means the person or organization using the service. By creating an account you accept these terms.

2. What the service is

Findingbase collects published records of US federal contract awards, works out which of them have a period of performance ending soon, scores each one against a fixed set of rules, and sends you the ones that match the NAICS codes, states and minimum amount you chose. It also publishes summary pages by industry code that anyone can read without an account.

It is an information service. It is not a bidding platform, it does not submit anything on your behalf, and it is not legal, accounting, capture or procurement advice.

3. Accounts

  • Sign-in is by a single-use link sent to your email address. There is no password, so the security of your account is the security of your mailbox: keep control of it, and tell us at once if you lose that control.
  • One account belongs to one organization. You may let colleagues use it; you stay responsible for what they do with it.
  • You must give an email address you actually monitor. Alerts are the product; an address that bounces is an account that does nothing.

4. Subscriptions, billing and cancellation

  • Plans and prices are shown on the pricing section of this site and are charged monthly in advance through Stripe, our payment processor. We never see or store your card details.
  • Prices may change. [OPERATOR: fill] State the notice period for a price change and how it is given.
  • Taxes: [OPERATOR: fill] state whether prices include or exclude sales tax and VAT, and who accounts for it.
  • Refunds: [OPERATOR: fill] state the refund policy, including whether a part-month is refundable.
  • You can cancel at any time from the billing portal. The subscription then runs to the end of the period you have already paid for, and is not renewed.
  • If a payment fails, we keep the service running while the card issuer retries. If it keeps failing, the subscription ends and alerts stop.

5. Acceptable use

The contract records themselves are US government works; we claim no ownership of the facts in them, and you may do as you like with what you read here. What you may not do is take the service down or hollow it out:

  • no automated bulk extraction of the site beyond ordinary reading and the exports your plan includes;
  • no reselling access, or sharing one subscription across separate organizations;
  • no attempt to reach another customer’s data, or to test our defenses without written permission.

If you want the underlying data in bulk, take it from the source: USAspending publishes bulk downloads, free, without asking us.

6. Accuracy, and what we do not promise

Everything here is derived from federal systems we do not control. Those systems are late, incomplete and sometimes wrong, and our copy of them inherits every one of those faults. End dates get modified; options get exercised without the record changing that day; awards get canceled.

The renewal score is a set of five arithmetic rules applied to fields in the record. It is a way of ranking your reading, not a prediction. A high score does not mean a recompete will happen, and a low or absent score does not mean it will not. Where a contract has not been scored yet we say so, rather than showing you a zero.

The service is provided as it is, without warranty of any kind to the extent the law allows, including any warranty that it is fit for a particular purpose or that it will be available without interruption. [OPERATOR: fill] Counsel to set the warranty disclaimer for the chosen jurisdiction.

7. No government affiliation

Findingbase is an independent commercial service. It is not affiliated with, endorsed by, sponsored by or an official source for the United States government or any of its agencies, and nothing here is an official notice of a procurement.

8. Availability

We aim to keep the service running and the weekly import on schedule, but we do not offer a service level agreement. [OPERATOR: fill] If an SLA is offered, state the uptime commitment and the remedy.

9. Liability

[OPERATOR: fill] Counsel to draft the limitation of liability, including the cap, the excluded categories of loss, and any liability that cannot lawfully be excluded. A cap that is written badly is worse than none: this clause must be reviewed before the service takes a payment.

10. Suspension and termination

We may suspend or close an account that is not paid for, or that is being used in breach of section 5. You may close yours at any time from your profile page; doing so deletes your organization and everything attached to it, as described in the privacy policy.

11. Changes to these terms

We may change these terms. Material changes will be sent to the email address on the account [OPERATOR: fill] state the notice period, for example 30 days before they take effect. Continuing to use the service after that means you accept them.

12. Governing law and disputes

These terms are governed by the law of [OPERATOR: fill] governing law: state and country and disputes go to the courts of [OPERATOR: fill] venue, and whether arbitration or a class-action waiver applies.
